These terms and conditions ("Terms") govern your use of the Eikendal Vineyards website at bookings.eikendal.com and eikendal.com (the "Website"), and any wine purchases, tasting and experience bookings, restaurant reservations, accommodation bookings, events and Eikendal Club memberships made through it. By using the Website you agree to these Terms. If you do not accept them, please do not use the Website.

1. Who we are

The Website is operated by Eikendal Vineyards, a wine estate situated on Annandale Road (off the R44), Stellenbosch, 7600, Western Cape, South Africa ("Eikendal", "we", "us" or "our"). References to the "estate" include our cellar, tasting venue, Cucina di Giovanni restaurant, the Lodge and cottage, and our event spaces.

2. Age restriction

No alcoholic products are sold to, or may be ordered by, any person under the age of 18. By placing an order for wine or any alcoholic product you confirm that both you and the recipient are 18 years of age or older. We may request proof of age on delivery or collection and reserve the right to refuse or cancel any order where the legal age requirement is not met.

3. Use of the Website

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use of the Website. You may not attempt to gain unauthorised access to any part of the Website, its servers, or any connected systems.

We may update, suspend or withdraw all or part of the Website at any time without notice. We make reasonable efforts to keep the Website available but do not guarantee uninterrupted access.

4. Orders, pricing and payment

All wine sales are processed through our e-commerce provider. Prices are shown in South African Rand (ZAR) and include VAT where applicable. We make every effort to ensure prices and product information are accurate, but errors may occur; where we discover an error in the price of items you have ordered, we will notify you and give you the option to confirm the order at the correct price or cancel it.

A contract of sale comes into effect only once we have accepted your order and received full payment. We reserve the right to decline or cancel any order, including where stock is unavailable, where we suspect fraudulent activity, or where the age requirement is not satisfied.

5. Delivery and collection

Delivery timeframes are estimates only. Risk in the goods passes to you on delivery or collection. An adult aged 18 or older must be present to accept delivery of any alcoholic products. International orders are handled through our partners — please contact us for the best option based on your location.

6. Bookings, tastings and experiences

Tasting, experience, restaurant and accommodation bookings are subject to availability and to any specific booking, deposit and cancellation terms communicated to you at the time of booking. Please arrive at the time stated for your booking; late arrivals may result in a shortened experience or the release of your reservation.

7. Eikendal Club

Membership of the Eikendal Club, and any member benefits, pricing, allocations and events, are subject to the membership terms provided when you join. Benefits may change from time to time. Subscriptions renew and may be cancelled in accordance with those membership terms.

8. Intellectual property

All content on the Website — including text, images, video, logos, the Eikendal name and marks, and page design — is owned by or licensed to Eikendal and is protected by South African and international intellectual property laws. You may not reproduce, distribute or use any content for commercial purposes without our prior written consent.

9. Limitation of liability

To the extent permitted by law, Eikendal will not be liable for any indirect, incidental or consequential loss arising from your use of the Website, your visit to the estate, or any product or service purchased through the Website. Nothing in these Terms limits liability that cannot lawfully be limited, including under the Consumer Protection Act, 2008.

10. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect and process personal information in line with the Protection of Personal Information Act, 2013 (POPIA).

11. Governing law

These Terms are governed by the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of the South African courts.
